TERMS AND REGULATIONS OF ACCESS TO THE DATABASE OF QUESTIONS FROM THE STATE EXAMINATION OF MEDICAL DOCTOR (SED or LEP)

I General Terms and Conditions

1. Database of questions to the State Examination of Medical Doctor (SED or LEP), hereinafter referred to as the database, was created by the Młody Lekarz Association with a registered office in Warsaw at Kabacki Dukt str 5/74, entered into the National Court Register maintained by the District Court for the Capital City of Warsaw, XIII Commercial Division of the National Court Register under the number 0000244140, NIP: 9512164347, hereinafter referred to as the Association.

2. The database is designed to help prepare physicians to the Physician Final Exam (LEK), hereinafter referred to as the examination.

3. The database consists of 1200 questions from the 6 editions of the State Examination of Medical Doctor (SED or LEP) held between 2010-2012 accompanied by the comment to each question prepared by the Association.

4. The database includes all questions from the aforementioned editions of SED is a form in which they were publically published.

5. The database allows users to ask questions to the authors of the comments regarding the question.

6. The Association and the authors of comments reserve the right to answer only some questions asked by the person who bought access to the database.

7. Failure to obtain an answer to the question posed to the author does not provide a basis for reimbursement of fees for the access to the database.

8. The database has been developed within the framework of the statutory objectives of the Association.

9. Before buying access to the database, carefully read these Terms and Regulations.

10. A person buying an access to the database confirms that took note of the contents of the Terms and Regulations and accepts them.

II Conditions for access to the database

1. Access to the database can be obtained by a person above 18 years of age who is a student or medical school graduate, hereinafter referred to as the User.

2. The user is an individual consumer using the services in a way not directly related to his business or professional activity (in accordance with Art. 221 of the Act of 23 April 1964. Civil Code (Dz.U.1964.16.93)

3. To gain access to the database prior registration on www.mlodylekarz.pl website is needed.

4. Registration is done by filling the form present on the website and entering forename, surname and e-mail address.

5. Once completed and submitted to the indicated address, the User will receive, at their specified email address, the activation link to successfully complete the registration.

6. To use the database the User must accept these Terms and Regulations (by clearing the checkbox provided) and agree to the processing of personal data.

7. The Association processes User’s personal information in order to provide services at a distance and by electronic means. Processing of the data for other purposes depends on the expressed permission in this regard. Providing personal data by the User is voluntary, but the lack of consent to the processing of personal data by the Association may make electronic services impossible. The User has the right to access their personal data and to correct or remove them. The User is responsible for providing false personal data. The Association assures that personal data are processed in accordance with the principles laid down in the Act of 29 August 1997 on the protection of personal data in the cases and under the conditions laid down by the generally applicable provisions of law. The User has the right to require completion, updating, rectification of personal data, temporary or permanent suspension of their processing or removal if they are incomplete, outdated, untrue or collected in violation of the law or are no longer necessary for the purpose for which they were collected. The User has also the right to lodge his request to cease processing of personal data and to remove them. The User’s data can be made available to entities authorized to receive them under applicable law, including the relevant judicial authorities.

8. Administration of the User’s personal data is held by the Association.

9. Access to the database is only intended for a single user. In the case of recognition by the Association, that more then one individual uses the database from the same account, the Association has the right to delete an account without any refund of the unused amount.

10. After registering with the portal you can get free access to 100 questions (demo version) to familiarize with the functionality of the databases.

11. Access to the database is payable.

12. The cost of access to the database depends on the time of access as follows:
• for a period of 14 days - 199 zł
• for a period of 30 days - 359 zł
• for a period of 60 days - 599 zł
• for a period of 90 days - 799 zł
• for a period of 180 days - 999 zł

13. The fee for the access to the database is payable via the PayU system. These services are provided by PayU registered in Poznan, 60-166 Poznan, Grunwald str. 182, entered into the National Court Register maintained by the District Court in Poznań - Nowe Miasto and Wilda, VIII Commercial Division of the National Court Register, under KRS number 0000274399, with share capital in the amount of 4,000,000 PLN, paid in full, having a tax identification number NIP: 779-23-08-495, REGON 300523444 and under the Rules of services available at: http://www.payu.pl.

14. The User will receive notification of payment send electronically by the PayU system.

15. Time of access to the database is counted from the day following the confirmation of payment by the PayU system.

16. Access time ends at 23:59 on the last day of access to the database.

17. The invoices for the payment are sent by the Association to the email address provided during registration and during billing month, in which the payment was made.

18. The Association reserves the right to change the number of questions, the questions themselves and the content of reviews.

19. The Association reserves the right to change the pricing of services, while guaranteeing immutability of price for the period for which the User has paid.

20. Access to the database is possible via the following web browsers: Internet Explorer, FireFox, Opera, Safari, Chrome with enabled cookies.

21. The User agrees to use the database in accordance with its intended purpose, current Polish law, social and moral norms, provisions of these Terms and Regulations and the rules of etiquette, and in particular:
a. the use of the database in a way that does not undermine the rights of other Users,
b. to refrain from any action which might hamper or disturb the operation of the database and the use of the database in a manner disruptive to other Users,
c. to refrain from any acts violating the privacy of other Users, in particular the collection, processing and dissemination of information about other Users without their consent, unless it is permitted by law and the provisions of these Terms and Regulations,
d. to refrain from any actions that expose the Association to financial losses, in particular through the transfer of the purchased access to the database to other Users.
e. the observance of the copyrights and the rights arising from the registration of inventions, patents, trademarks, utility models and industrial of other individuals.

22. The User may not copy the database from the Association under penalty of perjury or civil liability. Activities aimed at attempting to copy comments to the questions or other content may also be regarded as an offense under the Penal Code;

23. The Association may cease to provide services, including deletion of the User’s account if the database is used in a manner inconsistent with:
a. its purpose or to the detriment of third parties,
b. the current Polish law, social and moral norms, provisions of these Terms and Regulations and the rules of etiquette.

24. The Association is not responsible for:
a. the damage caused by improper use of the database by the User;
b. inability to use the database if this occurs as a result of events which the Association, with due diligence, was not able to predict, or which could not be prevented, in particular random events of force majeure;
c. the effects resulting from entering into possession of a third party's account password;
d. the data loss resulting from hardware failure, system, or other circumstances beyond the control of the Association;
e. the damage caused by failure or delay in the mailing of the messages for reasons beyond the control of the Association.

III Cancellation policy

1. The consumer has the right to cancel the order to activate the database until the start of the use of the database, but no later than 14 (fourteen) calendar days after the date of the agreement. The Association returns the payment to the bank account or to the address indicated by the consumer immediately and no later than within 14 (fourteen) calendar days from the date of receipt of the notification of withdrawal from the contract.

2. The notification of withdrawal may be delivered in any way, as far as the Association has the opportunity to get acquainted with its contents. Withdrawal form is attached as Appendix 1 to these Terms and Regulations.

3. The right of withdrawal is not entitled to a consumer in relation to a contract for the supply of digital content, which is not stored on a tangible medium if the performance has begun after clear consent of the consumer before the deadline to withdraw from the contract and after having informed him by the Association of loss of the right to withdraw from the contract (in accordance with art. 38 of the Act of 30 May 2014. on consumer rights - unified text dated 24 June 2014., Dz. U. of 2014., pos. 827).

4. The consumer agrees to the commencement of the service by accepting the checkbox stating "I consent to the commencement of service before the deadline to withdraw from the contract and I was informed of the impossibility to withdrawal after its execution".

IV Complaints

1. Disruption in the functioning of the database, concerns and comments related to the services provided by the Association may be sent by e-mail to:This email address is being protected from spambots. You need JavaScript enabled to view it..

2. A complaint regarding non-performance or improper performance of services must include in particular the subject of the matter and its adequate justification.

3. A complaint will be examined by the Association within a period not exceeding 14 calendar days from the date of receipt of the complaint. In this period the user will be informed of the outcome of the claim in an electronic message sent to the e-mail address indicated in the complaint.

4. Claims made to the Association regarding services provided by third parties will not be considered by the Association. Association is not obliged to transmit the complaint to the relevant body, responsible for the implementation of the complaint.




V Final clauses

1. In matters not covered in these Terms and Regulations, in particular those concerning declaration of will in electronic form, the Civil Code and other generally applicable provisions of laws are applied.

2. Regulations come into force on 30th June 2015.

3. The Terms and Regulations are provided free of charge before the conclusion of a contract for the services in a way that allows the User to obtain, reproduce, and store its content via the communication system used by the recipient.

4. The Association reserves the right to change the Terms and Regulations by informing the Users.

5. Before the amendment to the Terms and Regulations, each User will be informed electronically about the planned change. Lack of objections by the User within 7 days of receipt of the message shall be deemed as acceptance of the proposed changes.

6. If the User does not accept the change, it should be reported to the Association in form of an e-mail to: This email address is being protected from spambots. You need JavaScript enabled to view it.. Lack of acceptance of the Rules is synonymous to resignation from the use of the database. The user shall bear the costs of services in an amount, which corresponds to the period of actually provided services. The amount overpaid by the User shall be recovered immediately, but no later than within 14 days from the date of account removal. Reimbursement will be made to the bank account or the address indicated by the User.

7. Any disputes arising as a result of the agreement between the User and the Association shall be dealt by the court in accordance with the provisions of the law in Poland.
